根据《中华人民共和国劳动法》和《深圳劳动合同条例》及其他有关法律法规的规定 , 甲乙双方本着平等自愿、协商一致的原则 , 达成如下协议 ：________________

一、工作岗位和工作 ( 工种 )

甲方根据工作(生产)需要 , 聘用乙方在 管理、技术 岗位从事 管理、技术 工作( 工种 ) 。

二、合同期限 ( 试用期限 )

( 一 ) 合同期限

甲乙双方选择以下第 1 种形式确定本合同期限。

三、工作时间

甲方由于生产经营需要 , 经与工会和乙方协商后 , 可延长工作时间 , 一般每日不得超过一小时 ; 因特殊原因需要延长工作时间的 , 在保障乙方身体健康的条件下延长工作时间每日不得超过三小时。加班加点每月不得超过三十六小时。

如属法律、行政法规规定的其他情形延长工作时间 , 不受上款规定限制。

四、工资待遇

( 一 ) 乙方试用期工资 1500 ________元 /________月 ; 试用期满乙方起点工资为 2200 ________元 /________月。甲方可按依法制定的或集体合同约定的工资分配制度调整乙方工资。但甲方支付给乙方的工资不得低于市政府公布的当年度最低工资标准。

( 三 ) 甲方安排加班加点的 , 按《劳动法》第四十四条规定支付工资报酬。

( 五 ) 乙方在工作时间内 , 按国家规定履行国家和社会义务时 , 工资照发。

( 六 ) 乙方停工期间的工资待遇按有关规定执行。

( 七 ) 乙方按国家有关规定享受休假权利 , 休假期间的工资按国家及省、市有关规定执行。

五、劳动保护和劳动条件

( 一 ) 甲方必须为乙方提供符合国家规定的劳动安全、卫生条件和必要的劳动防护用品 , 对从事有职业危害作业的劳动者应当定期进行健康检查。

( 二 ) 乙方对甲方管理人员违章指挥强令冒险作业 , 有权拒绝执行 ; 对危害生命安全和身体健康的行为 , 有权提出批评检举和控告。

六、社会保险和福利待遇

( 一 ) 甲方按深圳市社会保险的有关规定 , 为乙方办理社会保险。

( 二 ) 乙方因工致伤残、死亡的 , 按《深圳工伤保险条例》及有关规定处理。

( 二 ) 甲方在经济条件允许的情况下应不断提高乙方的福利待遇。

七、劳动纪律

乙方在合同期内应当做到 ：________________

( 一 ) 遵守甲方依法制定的各项规章制度。

( 二 ) 严格遵守安全操作规程 , 保证安全生产。

( 二 ) 按时完成甲方规定的工作任务。

八、合同的变更、解除、重新订立和终止

( 一 ) 经甲、乙双方协商同意可以依法变更劳动合同。

( 二 ) 有下列情形之一的 , 甲方可以随时解除劳动合同 ;

1 、乙方在试用期间被证明不符合录用条件的 ;

2 、乙方严重违反劳动纪律或者用人单位规章制度的 ;

3 、乙方严重失职 , 营私舞弊 , 对甲方利益造成重大损害的 ;

4 、乙方被依法追究刑事责任的 ;

5 、法律、法规规定的其他情形。

( 三 ) 有下列情形之一的 , 甲方可以解除劳动合同 , 但是应当提

前三十日以书面形式通知乙方本人。

1 、甲方濒临破产进行法定整顿期间或者生产经营状况发生严重困难 , 经劳动局确认确需裁减人员的 ;

2 、乙方患病或非因工负伤 , 医疗期满后 , 不能从事原工作也不能从事由甲方另行安排的适当工作的 ;

3 、 乙方不能胜任工作 , 经过培训或者调整工作岗位 , 仍不能胜任工作的 ;

4 、本合同订立时所依据的客观情况发生重大变化 , 致使原劳动合同无法履行 , 经甲乙双方协商不能就变更劳动合同达成协议的。

( 四 ) 有下列情形之一的 , 甲方不得依据本条第二款的规定解除劳动合同 ：________________

1 、乙方患职业病或因工负伤并被确认丧失或者部分丧失劳动能力的 ;

2 、乙方患病或非因工负伤 , 在规定的医疗期内的 ;

3 、乙方在孕期、产期、哺乳期内的 ;

( 五 ) 有下列情形之一的 , 乙方可以随时通知甲方解除劳动合同 ：________________

( 九 ) 合同终止

合同期满或双方约定的终止条件出现 , 合同自行终止。

九、违约责任

( 一 ) 甲方的法律责任

1 、甲方克扣或者无故拖欠乙方工资的 , 以及拒不支付乙方加班加点工资的 , 除全额支付乙方工资报酬外 , 还应加发相当于工资报酬 25% 的经济补偿金。

2 、甲方支付乙方的工资报酬低于市政府公布的当年最低工资标准的 , 要补足低于标准部分 , 同时 , 对低于部分每日另按其总额的 1% 补偿员工。

3 、甲方违反本合同第六条第 ( 一 ) 款未为乙方办理社会保险 ,给乙方造成经济损失的 , 由甲方按深圳市社会保险的有关规定赔偿乙方。

4 、符合下列情形之一的 , 甲方应一次性发给乙方经济补偿金：________________

a 、由甲方提出 , 经双方协商同意解除劳动合同的 ;

b 、甲方依本合同第八条第 ( 三 ) 款第 1 、 2 、 3 、 4 项和第 ( 五 )款第 2 、 3 、 4项解除劳动合同的。

5 、甲方依本合同第八条第 ( 三 ) 款第 2 项解除劳动合同的 , 甲方按国家有关规定发给乙方一次性的医疗补助费。

6 、甲方依本合同第八条第 ( 三 ) 款第三 3 、 4 项解除劳动合同 , 未提前三十日通知乙方的 , 支付乙方当年一个月月平均工资的补偿金。

( 二 ) 乙方的法律责任

乙方违反合同约定解除劳动合同 , 对甲方造成损失的 , 乙方应赔偿甲方下列损失 ：________________

2 、甲方为其支付的培训费用 ;

3 、对生产、经营和工作造成的直接经济损失。

十、争议处理

甲乙双方发生劳动争议后 , 应允协商解决。协商不成的 , 可以向甲方劳动争议调解委员会 ( 小组 ) 申请调解 ; 也可以直接向劳动争议仲裁委员会申请仲裁。对仲裁裁决无异议的 , 双方必须履行 ; 对仲裁裁决不服的 , 可以向人民法院起诉。

十一、双方认为需要约定的其他事项或对原订条款需要变更重新约定的事项 ：________________

1、在此期间内，乙方的学历证、职称证、资格证交由甲方人事管理人员统一管理，甲方有权无偿使用。

2、甲方为乙方办理社会保险的基数为深圳市社会保险有关规定规定的最低基数。

3、聘用期间，乙方须向甲方提供2200元的职业道德保证金，合同期满乙方若无违反职业道德行为甲方等额返还乙方。(职业道德保证金由甲方从乙方工资中分六个月等额扣取)。

十二、本合同未尽事宜或合同条款与现行劳动法律法规规定有出入的 , 按现行劳动法律法规执行。

十三、本合同自甲、乙双方签字或盖章之日起生效 , 涂改或未经书面授权代签无效。
