甲方基于下文所列各种因素，特与乙方达成了协议并一致同意：由甲方在订约日期之翌日起_____天之内为乙方建造并完成_____（涉约建筑）。涉约建筑之规模及所需的钢筋、水泥、砖块、石子和其它建筑材料之数量，均在作为附件的设计图和施工细则中予以说明。

甲方在建房屋一栋，建筑总面积约平方米，由乙方承包施工。经双方协商同意，特签订如下合同：

一、承包方式

采用包工包料方式承包。甲方提供建房土地、1——7楼图纸，乙方负责包括：红砖、河砂、碎石、石灰、水泥、钢材、水管、下水管、铁钉、扎丝、水电等。乙方提供劳务、建筑技术、模板、撑树、脚手架用材、码钉及生产生活用具等。

二、承建项目

乙方按照设计图纸或甲方提出的要求承建。甲方房屋主体工程的建筑，包括墙体、梁、柱、楼梯、楼面、装模、拆模、扎钢筋、现浇混凝土及地面、门前台阶砼垫层;装饰室内粗粉刷、外墙贴瓷砖、后墙面粉水泥砂浆、卫生间、大便器、下水管道、落水管;顶层层面加浆磨光，同时作好防渗处理。

三、承包价格

每平方米元，建筑面积按每层楼外墙计算。

四、付款方式

完成第一层砖砌并倒制好楼面付三万元，完成第二至五层均付款三万元元，经验收合格后付款。

五、质量要求

乙方应当按照国家规定的房屋质量标准和要求组织施工，不合格由乙方负责返工，返工费由乙方负责。

六、注意安全

文明施工，如果乙方施工人员出现工伤，因施工造成他人损伤等事故，一切由乙方负责，甲方不负担任何责任和费用。文明施工，讲究职业道德，讲究清洁卫生。

七、工期要求

主体工程工期为*个月，从签订合同之日起计算，乙方必须在*年*月*日前完成主体工程，完工时间不能超过天，乙方不能因各种原因拖延甲方建房完工时间。

八、质量保修期

双方根据《建设工程质量管理条例》的有关规定，约定本合同的质量保修期如下：

1、屋面防水工程，卫生间、房间和外墙面的防渗漏为2年

2、电线、排水管道，设备安装为2年保修期，期满后，付清工程建筑剩余15%

九、其它未尽事宜，由甲乙双方协商解决。

本合同一式二份，甲乙双方各执一份，从签字之日起生效。
