二、甲方责任及义务

5.对获证范围的管理体系运行的有效性和出现违反法规的相应事故负全责；

6.按国家有关认证的规定接受监督审核，并按时交纳相关费用；

7.获证后严格遵守中心有关认证证书和标识（牌）使用的规定，若暂停、撤销或注销认证证书，应立即停止涉及认证内容的广告及相关宣传活动。

三、乙方责任及义务

1.遵守国家法律、法规和认证规定；

2.在认证合同签订后10个工作日内，负责将《现场审核申请表》提供给甲方；

3.以标准为依据，严格依照程序开展认证工作；

4.审核中涉及甲方保密的内容，未经甲方允许，保证不外泄（认可机构、法律机构除外）；

5.对组织的管理体系实施认证审核的有效性负责；

6.对所颁发的认证证书的有效性负责，获证后甲方在认证证书有效期内发生认证证书覆盖范围内的食品安全事故时，负有连带责任。

四、认证费用及付款方式

（一）初审认证费用：

根据《民法典》及中国认证机构国家认可委员会（cnab）和中国节能产品认证管理委员会（ccec）的有关规定，合同双方就产品认证项目协商一致，签订本合同。

一、内容和范围

1.总则

二、质量体系审核和产品抽样检验

2.收费标准：

四、甲方的责任和义务

1.在产品认证实施各阶段中，按认证活动进展情况或乙方通知，向乙方提交有关文件和资料或进行必要的工作。

2.在实施产品认证时，应提供至少三个月的质量体系运行的有效证据。

3.认证活动开始前，应向乙方明确甲方的保密要求和特殊要求。

4.应向乙方无偿提供抽样检验的样品，负责把抽取的样品按乙方规定的时间，运送到指定的检验机构。甲方保留回收抽检产品的权利。

5.向乙方在甲方现场执行认证任务的人员免费提供通讯设施，交通工具，办公设施和联络向导及其它必要资源。

6.应按期向乙方及检验机构交付各项认证费用。

7.除本合同规定的条款外，甲方不应再以任何方式或名义向审核/抽样/检验人员馈赠钱，物（包括纪念品，加班费，劳务费等）。一旦发现，乙方将终止认证活动并视认证结果无效。
